Effective date: 20 April 2026 - Last updated: 2 November 2026

The Agents Union (“we,” “us,” “our,” or “the Association”) respects your privacy and is committed to protecting your personal data. This Privacy Policy explains what information we collect when you visit theagentsunion.com (the “Site”) or interact with us, how we use it, who we share it with, and the rights you have over it.

If you have any questions about this policy or how we handle your data, please contact us at kanishka@theagentsunion.com.

1. Who we are

The Agents Union is a professional association for football agents, established under the Swiss Civil Code. We operate this Site as an informational resource for our members, prospective members, and the wider public.

For the purposes of the Swiss Federal Act on Data Protection (FADP), the EU General Data Protection Regulation (GDPR), and equivalent laws, the data controller for personal data collected through this Site is:

The Agents Union, Dornacherstrasse 179a, 4054 Basel, Switzerland - Email: kanishka@theagentsunion.com

2. Information we collect

The Site has no user accounts and no login. We only collect personal data when you actively submit it through one of the three forms on the Site, plus limited technical data that is inherent to running a website.

2.1 Information you provide directly

  • Contact form: your name, phone number, email address, the subject you select, and the content of your message.
  • Newsletter sign-up: your email address and, optionally, your name.
  • Membership application: your name, date of birth, nationality, email address, phone number (including country code), agency/company, role, FIFA licence date and number, licensing football association, how long you have been active as an agent, how you heard about us, and (optionally) your motivation for joining.
  • Correspondence with us by email.

We only ask for information we actually need to handle your enquiry, send you our newsletter, or assess your membership application.

2.2 Technical information

The Site does not use analytics, tracking pixels, or advertising technologies, and we do not build profiles of visitors. However, as with any website:

  • Our hosting/CDN provider processes your IP address and basic request data (pages requested, browser type, timestamps) in server logs for the purpose of delivering the Site and protecting it against abuse.
  • Fonts are loaded from Google Fonts. When your browser requests a font file, your IP address is transmitted to Google. See Google’s privacy policy for details.

See our Cookie Policy for details on cookies (in short: we do not set any).

3. How we use your information

We use your personal data only for the following purposes:

  • To respond to your enquiries submitted through the contact form or by email.
  • To send you our newsletter, if you have signed up for it. You can unsubscribe at any time.
  • To assess and administer membership applications, including verifying licence details and, where relevant, following up with you about your application.
  • To protect the Site, including preventing fraud, abuse, and security incidents.
  • To comply with legal obligations and respond to lawful requests from authorities.

We do not sell your personal data, we do not use it for advertising, and we do not use it for automated decision-making that produces legal or similarly significant effects on you.

Where the GDPR applies, we process your personal data on the following legal bases:

  • Responding to your enquiries - our legitimate interest in answering you, and steps taken at your request (Art. 6(1)(f) and (b))
  • Sending you our newsletter - your consent (Art. 6(1)(a))
  • Assessing membership applications - steps taken at your request prior to entering into membership (Art. 6(1)(b))
  • Security and abuse prevention - our legitimate interests in protecting the Site (Art. 6(1)(f))
  • Complying with legal obligations - legal obligation (Art. 6(1)(c))

You may withdraw your consent at any time where consent is the legal basis. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

5. How we share your information

We share personal data only as described below. We do not sell your personal data.

  • Service providers who process data on our behalf and under our instructions: website hosting and content delivery, email delivery (for the newsletter and for receiving form submissions), and font delivery (Google Fonts, as described above).
  • Professional advisors, such as lawyers, auditors, and insurers, where necessary.
  • Authorities and other parties, where required by law, court order, or to protect our rights, the rights of our members, or the safety of others.

A current list of key service providers is available on request.

6. International data transfers

The Agents Union operates from Switzerland. Switzerland is recognised by the European Commission as providing an adequate level of data protection.

Some of our service providers (for example, our hosting/CDN provider and Google) may process data in countries outside Switzerland and the EEA, including the United States. Where that is the case, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses or an applicable adequacy decision. You can request more information about these safeguards by contacting us.

7. Cookies and tracking

We do not set cookies on this Site, and we do not use analytics, tracking pixels, social media buttons, or advertising technologies. That is also why the Site does not show a cookie banner - there is nothing to consent to.

Our hosting provider may, in rare cases, set a strictly necessary security cookie (for example, for protection against automated abuse). Such cookies require no consent and store no profile about you.

If we introduce cookies or analytics in the future, we will update this policy and our Cookie Policy first, and ask for your consent where the law requires it.

8. Data retention

We keep personal data only for as long as we need it for the purposes described in this policy, or as required by law. In general:

  • Contact form submissions and email correspondence: deleted no later than 12 months after your enquiry has been resolved, unless an ongoing relationship requires longer retention.
  • Newsletter data: kept until you unsubscribe, after which we retain only the minimal record needed to honor your unsubscribe request.
  • Membership applications: kept for the duration of the assessment. If your application is approved, the data becomes part of your membership record. If it is declined or withdrawn, it is deleted no later than 12 months afterwards, unless you ask us to keep it on file or the law requires otherwise.
  • Server logs (held by our hosting provider): kept for short, defined periods in line with security and continuity requirements.

9. Your rights

Depending on where you live, you may have the following rights in relation to your personal data:

  • Access - request a copy of the personal data we hold about you.
  • Rectification - ask us to correct inaccurate or incomplete data.
  • Erasure (“right to be forgotten”) - ask us to delete your data, subject to certain exceptions.
  • Restriction - ask us to limit how we use your data.
  • Objection - object to processing based on our legitimate interests, including direct marketing.
  • Portability - receive your data in a structured, machine-readable format, or have it transmitted to another controller.
  • Withdraw consent - at any time, where we rely on consent (for example, the newsletter).
  • Lodge a complaint with a supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC). If you are in the EU, you can find your authority via the European Data Protection Board.

To exercise any of these rights, please contact us at kanishka@theagentsunion.com. We may need to verify your identity before responding. We will respond within the timeframes required by applicable law (typically within one month under GDPR).

10. Security

We take reasonable technical and organizational measures to protect your personal data against unauthorized access, loss, misuse, and alteration. These include encrypted connections (HTTPS), access controls, data minimisation (we only collect what we need), and ongoing review of our practices.

No method of transmission over the internet or electronic storage is 100% secure, however, and we cannot guarantee absolute security. If we become aware of a personal data breach that affects you, we will notify you and the relevant authorities as required by law.

11. Children’s privacy

The Site is not directed to children under the age of 16, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can delete it.

The Site may contain links to third-party websites or services (for example, our partners or social media profiles). We are not responsible for the privacy practices of those third parties, and we encourage you to read their privacy policies before sharing your data.

13. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by posting the updated policy on the Site and, where appropriate, by email. The “Last updated” date at the top of this page indicates when the policy was last revised.
